Terms of Service

This is a draft for review. These terms are not legal advice and should be reviewed by a qualified attorney before Safelight accepts paying customers.

1. The Service

Safelight ("we," "us") provides photographers with hosted websites, client galleries, and online stores for selling prints and digital products ("the Service"). By creating an account or using the Service, you agree to these Terms.

Safelight is operated by Chase Sinner, a sole proprietor based in Scottsdale, Arizona.

2. Your Account

You must be at least 18 years old to create an account.
You are responsible for maintaining the security of your account credentials.
You agree to provide accurate business and contact information.
One account per photographer or studio. Contact us for multi-photographer studios.

3. Your Content

You retain all rights to the photographs and content you upload.
You grant us a limited license to host, display, and deliver your content as necessary to operate the Service.
You represent that you have all necessary rights to the content you upload, including model releases where required.
We do not claim ownership of your work. We will never sell, license, or use your photographs for our own purposes without your written consent.
We never delete your uploaded work. If you cancel, your content remains available for export for 90 days.

4. Plans and Payment

Launch: $249 setup + $49/month. Store: $499 setup + $79/month.
Setup fees are non-refundable once your designed gallery build begins.
Monthly subscriptions renew automatically. Cancel anytime; your site stays live until the end of the billing period.
0% commission: We take no percentage of your sales. Payment processing fees charged by your payment provider (e.g., Stripe) apply.
You connect your own Stripe account. You are responsible for your Stripe account standing, tax collection, and compliance.

5. Acceptable Use

You agree not to use the Service to:

Upload content you do not have rights to distribute.
Distribute unlawful, defamatory, or infringing material.
Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
Upload malicious files or engage in bulk automated access that degrades performance for others.

6. Uptime and Liability

We aim for high availability but do not guarantee uninterrupted service.
To the maximum extent permitted by law, our liability is limited to the fees you paid in the 12 months preceding a claim.
We are not liable for indirect, incidental, or consequential damages, including lost revenue from store downtime.

7. Termination

You may cancel at any time from your account settings.
We may suspend or terminate accounts that violate these Terms, with notice where practical.
On termination, you have 90 days to export your content, after which it may be permanently deleted.

8. Changes

We may update these Terms. Material changes will be communicated by email at least 14 days before taking effect. Continued use after changes take effect constitutes acceptance.
